【摘要】证明标准应当是刑事诉讼法最为重要的内容，它直接决定着刑事诉讼活动的方向。但是我国刑诉法并未对证明标准作明确、具体的规定，而只作了原则性的规定，因而即造成了长期以来对此问题的不同理解，比较占上风的意见认为，在我国，刑事诉讼的证明标准是客观真实。而笔者通过对“客观真实”标准不可逾越的缺陷以及其在实践中的难以实现性的分析，通过对司法实践以及现行法律的深入研究，得出的结论正好与此相反，即我国现行的刑事诉讼证明标准并非客观真实标准，而是法律真实标准，而且随着1996年我国修改刑诉法以后，诉讼模式由职权主义诉讼模式转换为兼具职权主义与当事人主义特征的混合型诉讼模式，这一结论更加得到了凸显。

【Abstract】Proved that the standard must be the Law of Criminal Procedure most important content, it was deciding directly the criminal prosecution moves direction. But our country punishment sues the law not to do to the proof standard is clear about, the specific stipulation, but has only made the principled stipulation, thus namely has created since long to this question different understanding, compared with the opinion which is in the upper hand believed that in our country, criminal prosecution’s proof standard is objective real. But author through right “objective real” standard insurmountable flaw as well as it with difficulty possibility analysis in reality, through to the judicial practice as well as current law's deep research, the conclusion which obtains happen to the contrary, namely our country present criminal prosecution proves the standard by no means objective real standard, but is the legal real standard, moreover our country revised after 1996 the punishment sued the law, the lawsuit pattern by the authority principle lawsuit schema translation to have both the authority principle and the litigant principle characteristic mixed lawsuit pattern, this conclusion even more obtained has highlighted.

长期以来我国法学界认为我国刑事诉讼采用的是“客观真实”证明标准，并将其与西方国家的法律真实的证明标准对立起来。近年来，“客观真实”的证明标准在我国法学界受到激烈的批判。我认为，不论从我国的刑事诉讼立法，还是从我国的刑事审判实践看，我国刑事诉讼采用的证明标准并不是“客观真实”，我国刑事诉讼证明标准与西方国家法律真实的证明标准并无本质的不同，客观真实的证明标准只存在于法学专家的法学著作里。
