【摘要】在日常生活中，引水灌溉农地的行为被人们习惯地、普遍地、简单地理解为使用水的行为。然而，经过仔细地比较研究所有权的使用权能与处分权能，可以发现：使用权能与处分权能两者最核心、最根本的区别是实现各自的不同目的后是否实质上改变、毁损、消灭标的物或改变标的物的物理性质。引水灌溉农地的行为是通过水利设施把水引到农地灌溉，目的是为了利用水的灌溉功能，但同时又消耗、毁损、消灭了水或改变了水的物理属性，也就是说处分水的行为随之发生。因此，灌溉农地中的水应当认定为消耗物，对消耗物的使用即构成了处分。本文以此为切入点，结合我国与水资源相关的法律法规，对引水灌溉农地中的水资源的权属问题及该行为的合法性进行分析，旨在为引水灌溉农地行为的法律保障展开一些有益的探讨。

　　【英文摘要】In daily life， the acts for irrigation of agricultural land was accustomed ， generally， simple to be understood for the use of water.However， after a careful comparative study of the use of empowerment and disposition ，can be found that： the use of competence and powers to the two most central， most fundamental difference is that the realization of their different purposes whether in fact altered， defaced， or changed the subject matter of the physical properties. The water for irrigation of farm land which through the conservancy facilities and then be diverted to the irrigation of agricultural land， the purpose of the use of irrigation water features.But at the same time， consumption， destruction， the elimination of water or changes for the physical properties of water had happened ，in a other word ，Action of water means that the ensuing.Therefore， the irrigation of agricultural land in the water consumption should be identified as objects of consumption or use of objects constitutes a punishment.This article use it as a starting point，Combination of Chinas water-related laws and regulations， water diversion for irrigation of agricultural land in the ownership of water resources issues and the analysis of the legality of acts，the purposes to conduct water for irrigation of agricultural land to provide legal support and protection of some useful discussions.
