中华人民共和国政府和斐济主权民主共和国政府（以下简称“缔约双方”），本着发展两国之间友好关系和加强两国之间领事关系的共同愿望，就斐济主权民主共和国在中华人民共和国香港特别行政区保留名誉领事馆问题达成协议如下：一、中华人民共和国政府同意斐济主权民主共和国政府在中华人民共和国香港特别行政区保留名誉领事馆，领区为香港特别行政区。二、名誉领事官员应根据一九六三年《维也纳领事关系公约》和中华人民共和国香港特别行政区有关法律和规定执行领事职务并享有相应的特权与豁免。三、中华人民共和国政府应根据一九六三年《维也纳领事关系公约》及中国有关法律和规定，为斐济主权民主共和国驻中华人民共和国香港特别行政区名誉领事馆及其名誉领事官员执行领事职务提供必要的协助和便利。四、缔约双方应本着协商合作的精神，根据《维也纳领事关系公约》和国际惯例，友好地处理两国间的领事问题。五、名誉领事官员应是缔约双方公民或第三国公民，但不得是无国籍者或双重国籍者，且必须是中华人民共和国香港特别行政区永久性居民。六、斐济主权民主共和国向中华人民共和国香港特别行政区委派职业领事后不得再委派名誉领事。七、本协定自一九九七年七月一日起生效。本协定于1997年6月20日在苏瓦签订，一式两份，每份都用中文和英文写成，两种文本同等作准。侯清儒中华人民共和国斐济主权民主共和国政府代表政府代表侯清儒博列中国驻斐济大使斐济外交部长agreementbetweenthegovernmentofthepeople'srepublicofchinaandthegovernmentofthesovereigndemocraticrepublicoffijiconcerningthemaintenancebythesovereigndemocraticrepublicoffijioftheconsularpostheadedbyanhonoraryconsulinthehongkongspecialadministrativeregionofthepeople'srepublicofchina(suvaonjune20,1997)wholedocumentthegovernmentofthepeople'srepublicofchinaandthegovernmentofthesovereigndemocraticrepublicoffiji(hereinafterreferredtoas"thetwoparties"),outofacommondesiretodevelopfriendlyrelationsandenhanceconsulartiesbetweenthetwocountries,havereachedthefollowingagreementconcerningthemaintenancebythesovereigndemocraticrepublicoffijioftheconsularpostheadedbyanhonoraryconsulinthehongkongspecialadministrativeregionofthepeople'srepublicofchina:1.thegovernmentofthepeople'srepublicofchinaagreestothemaintenancebythegovernmentofthesovereigndemocraticrepublicoffijioftheconsularpostheadedbyanhonoraryconsulinthehongkongspecialadministrativeregionofthepeople'srepublicofchina,withthehongkongspecialadministrativeregionasitsconsulardistrict.2.thehonoraryconsularofficersshallexercisetheconsularfunctionsinaccordancewiththeviennaconventiononconsularrelationsof1963andtherelevantlawsandregulationsofthehongkongspecialadministrativeregionofthepeople'srepublicofchina,andenjoythecorrespondingprivilegesandimmunities.3.thegovernmentofthepeople'srepublicofchina,inaccordancewiththeviennaconventiononconsularrelationsof1963anditsrelevantlawsandregulations,shallaccordnecessaryassistanceandfacilitiestotheconsularpostheadedbyanhonoraryconsulofthesovereigndemocraticrepublicoffijianditshonoraryconsularofficersinthehongkongspecialadministrativeregionofthepeople'srepublicofchinaintheexerciseofitsconsularfunctions.4.thetwopartiesshallhandleconsularmattersbetweentheminafriendlymannerinaspiritofconsultationandco-operation,andinaccordancewiththeviennaconventiononconsularrelationsandinternationalpractice.5.thehonoraryconsularofficersshallbenationalsofeitherpartyorathirdcountry,butnotstatelesspersonsorthosewithdualnationalities,andmustbepermanentresidentsofthehongkongspecialadministrativeregionofthepeople'srepublicofchina.6.thesovereigndemocraticrepublicoffijishallnotappointanyhonoraryconsularofficersonceithasappointedcareerconsularofficerstothehongkongspecialadministrativeregionofthepeople'srepublicofchina.7.thepresentagreementshallenterintoforceon1july1997.doneatsuvathis20thdayofjune,1997induplicateinthechineseandtheenglishlanguages,bothtextsbeingequallyauthentic.forthegovernmentoftheforthegovernmentofthepeople'srepublicofchinasovereigndemocraticrepublicoffiji
