       1974年国际海上人命安全公约1988年议定书

  本议定书各缔约国,
  作为1974年11月1日在伦敦签订的《国际海上人命安全公约》的缔约国,
  认识到在上述公约中关于检验与证书的规定引入与其他国际文件中相应规定协调一致的需要,
  考虑到满足这一需要的最佳办法是缔结一项关于《1974年国际海上人命安全公约》的议定书,
  特议定下列各条:
  第Ⅰ条 一般义务
  1 本议定书各缔约国承担义务实施本议定书及其附则的各项规定,该附则应构成本议定书的组成部分。凡引用本议定书时,同时也就是引用该附则。
  2 在本议定书各缔约国之间适用经修正的《1974年国际海上人命安全公约》(以下简称“公约”)的规定时,亦应遵守本议定书列出的各项修正及补充规定。
  3 对于悬挂非公约和本议定书缔约国旗帜的船舶,本议定书缔约国应实施公约及本议定书的各项必要的规定,以保证不给此类船舶予以更为优惠的待遇。
  第Ⅱ条 以前的条约
  1 在本议定书缔约国之间,本议定书代替并废除关于公约的1978年议定书。
  2 尽管本议定书有任何其它规定,某一缔约国根据和按照公约规定所签发的任何证书及根据和按照公约的1978年议定书规定所签发的任何证书的补充,在本议定书对该缔约国生效时在使用中,应继续保持有效,直至按情况根据公约或公约的1978年议定书规定失效时为止。
  3 本议定书的缔约国应不再根据和按照1974年11月1日通过的《1974年国际海上人命安全公约》的规定签发证书。
  第Ⅲ条 资料的送交
  本议定书各缔约国承担义务向国际海事组织(以下简称“本组织”)秘书长通知和交存下列事项:
  (a)已颁布的有关本议定书范围内各种事项的法律、法令、命令、规章和其它文件的文本;
  (b)经授权在海上人命安全事项方面代表主管机关行事的被任命的验船师或被承认的机构名单及他们的具体职责和授权代表的条件,以便分送各缔约国供其官员参考;
  (c)根据本议定书规定颁发的数量足够的证书样本。
  第Ⅳ条 签字、批准、接受、核准和加入
  1 本议定书自1989年3月1日起至1990年2月28日止在本组织总部开放供签字,此后继续开放供加入。除本条之3的规定外,各国可按下列方式表达同意承担本议定书的义务:
  (a)签字并对批准、接受或核准无保留;或
  (b)签字而有待批准、接受或核准,随后再予批准、接受或核准;或
  (c)加入。
  2 批准、接受、核准或加入,应向本组织秘书长交存一份相应的文件。
  3 只有已对公约签字而无保留、批准、接受、核准或加入的国家,才可对本议定书签字而无保留、批准、接受、核准或加入。
  第Ⅴ条 生效
  1 本议定书在下列两个条件都满足之日起经过12个月之后生效:
  (a)不少于15个国家,其合计商船总吨位不少于世界商船总吨位的50%,按第Ⅳ条规定已表达同意承担本议定书的义务,和
  (b)《1966年国际载重线公约》的1988年议定书生效条件已满足,但本议定书不早于1992年2月1日前生效。
  2 凡在本议定书生效条件满足之日后,但在生效日期前交存批准、接受、核准或加入本议定书文件的国家,其批准、接受、核准或加入应在本议定书生效日期时生效,或在交存文件之日起3个月后生效,二者中取较后的日期。
  3 凡在本议定书生效之日后交存批准、接受、核准或加入的文件,应在交存之日起3个月后生效。
  4 凡在本议定书的修正案根据第Ⅵ条认为已被通过之日后交存任何批准、接受、核准或加入的文件,应适用于已经修正的本议定书。
  第Ⅵ条 修正
  公约第Ⅷ条中制订的程序应适用于本议定书的修正,其条件是:
  (a)该条涉及公约和缔约国政府即各意味着涉及本议定书和缔约国;
  (b)对本议定书条文及其附则的修正,应按对公约条文的修正或其附则第Ⅰ章修正适用的程序通过和生效;和
  (c)对本议定书附则的附录的修正可按(除公约第Ⅰ章外)公约附则修正适用的程序通过和生效。
  第Ⅶ条 退出
  1 任何缔约国在本议定书对其生效满5年后,可以随时退出本议定书。
  2 退出应在向本组织秘书长交存退出文件后有效。
  3 退出应在本组织秘书长收到退出文件一年后,或在退出文件中载明的较此为长的期限后生效。
  4 一缔约国退出公约即被认为该缔约国退出本议定书。在按公约第Ⅺ条之(c)规定退出公约生效的同日,退出本议定书亦即生效。
  第Ⅷ条 保存
  1 本议定书应交本组织秘书长(以下简称保管人)保存。
  2 保管人应:
  (a)通知本议定书的所有签字国或加入国的政府:
  (i)每一新的签字或批准、接受、核准或加入的文件的交存及其日期;
  (ii)本议定书的生效日期;
  (iii)任何退出本议定书文件的交存及其收到日期以及退出的生效日期;
  (b)将核证无误的本议定书副本分送本议定书的所有签字国或加入国的政府。
  3 本议定书一经生效后,保管人应即按照《联合国宪章》第102条的规定,将核证无误的副本一份送联合国秘书处登记并公布。
  第Ⅸ条 文字
  本议定书正本一份,用阿拉伯文、中文、英文、法文、俄文和西班牙文写成,各种文本具有同等效力。意大利文的官方译本应译就,并与签署的正本一起保存。

               第Ⅰ章 总则

            A部分 适用范围、定义等

  第2条 定义
  本条之(k)的现有文字用下文替代:
  “(k)“新船”系指在1980年5月25日或以后安放龙骨或处于相应建造阶段的船舶。”
  在现有条文中加入下文:
  “(n)“周年日”系指相应于有关证书满期日期的每年的月份和日期。”

              B部分 检验与证书

  第6条 检查与检验
  本条的现有文字用下文替代:
  “(a)就实施和免除本规则的规定而言,船舶的检查和检验应由主管机关的官员进行,但是主管机关可以委托由其指定的验船师或由其认可的组织来进行此种检查和检验。
  (b)指定验船师或认可某些组织进行本条之(a)所述的检查和检验的主管机关至少应授权指定的任何验船师或认可的任何组织:
  (i)要求对船舶进行修理;
  (ii)应港口国主管当局要求进行检查和检验。
  主管机关应将指定的验船师或认可的组织的具体责任和授权条件通知本组织。
  (c)如果经指定的验船师或经认可的组织确定船舶或其设备的状况在实质上与证书所载情况不符或者在此种状况下船舶出海会对船舶或船上人员造成危险时,该验船师或组织应立即保证纠正工作付诸实施并在适当时候通知主管机关,如果这种纠正工作没有付诸实施,则应收回有关证书并立即通知主管机关;如果船舶在另一缔约国的港口内,则也应立即通知该港口国的有关当局。在主管机关的官员、经指定的验船师或经认可的组织通知港口国的有关当局后,该港口国政府应向该官员、验船师或组织提供履行本规定的义务所必需的任何帮助。在适用时,有关的港口国政府应保证,只有对船舶或船上人员不会造成危险时,船舶才能出海航行或离港驶往适当的修理厂。
  (d)在任何情况下,主管机关均应充分保证检查和检验的完整性和有效性,并保证为履行此项义务作出必要安排。”
  第7条 客船的检验
  本条的现有文字用下文替代:
  “(a)客船应接受下列检验:
  (i)初次检验:在船舶投入营运前进行;
  (ii)换新检验:每12个月进行一次,第14(b)、(e)、(f)和(g)条所适用的情况除外;
  (iii)附加检验:视情进行。
  (b)上述检验应按下列规定进行:
  (i)初次检验应包括对船舶结构、机器和设备,并包括船底外部和锅炉内侧及外侧的全面检查。该检验要确保结构的布置、材料和结构用材尺寸、锅炉和其它受压容器及其附件、主机和辅机、电气设备、无线电设备(包括用于救生设备的无线电设备)、防火和消防安全系统及设备、救生设备和装置、船上装设的航行设备、航海出版物、引航员登船装置以及其它设备均完全符合本公约规则的要求以及主管机关据此规则为准备从事某种业务的船舶颁发的法律、法令、命令和规则的要求,该检验还应确保船舶各部分及其设备的工艺在所有方面均为合格,并确保该船已按本规则和现行《国际海上避碰规则》的规定配备了号灯、号型、音响信号发送装置和遇险信号。
  (ii)换新检验应包括结构、锅炉和其它受压容器、机器和设备的检查,并包括船底外部的检查。该检验应确保船舶的结构、锅炉和其它受压容器及其附件、主机和辅机、电气设备、无线电设备(包括用于救生设备的无线电设备)、防火和消防安全系统及设备、救生设备和装置、船上装设的航行设备、航海出版物、引航员登船装置以及其它设备均处于良好状况,并且适合其预定的用途,符合本规则和主管机关为此颁发的法律、法令、命令和规则的要求。船上的号灯、号型、音响信号发送装置和遇险信号也应接受上述检验,以确保它们符合本规则和现行《国际海上避碰规则》的要求;
  (iii)附加检验,视情可为总体或局部的,应在第11条规定的调查所导致的修理之后或在每次重大的修理或换新后进行。该检验应确保必要的修理或换新已经完成,此种修理或换新的材料和工艺在所有方面均为合格,船舶在所有方面均符合本规则、现行《国际海上避碰规则》以及主管机关为此颁布的法律、法令、命令和规则的规定。
  (c)(i)本条之(b)中所述的法律、法令、命令和规则应能全面确保该船在人命安全方面适合其预定的用途;
  (ii)其中应规定主锅炉和辅助锅炉、接头、蒸气管道、高压容器和内燃机的燃油柜的初次和而后的液压试验或其它可接受的替代试验需遵守的要求,包括必须遵守的试验程序和两次连续试验的间隔期限。”
  第8条 货船救生设备和其它设备的检验
  本条的现有文字用下文替代:
  “(a)下述本条之(b)(i)中所述的500总吨及以上的货船的救生设备和其它设备应接受下列检验:
  (i)初次检验:在船舶投入营运前进行;
  (ii)换新检验:按主管机关规定的间隔期进行,但不得超过5年,第14(b)、(e)、(f)和(g)条所适用的情况除外;
  (iii)定期检验:在货船设备安全证书的第二个周年日之前或之后的3个月内进行,或者在该证书的第三个周年日之前或之后的3个月内进行,定期检验应取代本条之(a)(iv)中规定的某次年度检验;
  (iv)年度检验:在货船设备安全证书每一周年日之前或之后的3个月内进行;
  (v)附加检验:与第7(b)(iii)条中对客船的规定相同。
  (b)本条之(a)中所述的检验应按下列规定进行:
  (i)初次检验应包括对消防安全系统及设备、救生设备和装置(不包括无线电设备)、船上装设的航行设备、引航员登船装置以及第Ⅱ-1、Ⅱ-2、Ⅲ和Ⅴ章所适用的其它设备的全面检查,以确保它们符合本规则的要求,处于良好状况,适合预定的用途。防火控制图、航海出版物、号灯、号型、音响信号发送装置和遇险信号也应接受上述检验,以确保它们符合本规则的要求,并在适用时,符合现行《国际海上避碰规则》的要求;
  (ii)换新检验和定期检验应包括对本条之(b)(i)中所述设备的检查,以确保其符合本规则和现行《国际海上避碰规则》的有关要求,处于良好状况,并适合预定的用途;
  (iii)年度检验应包括对本条之(b)(i)中所述设备的全面检查,以确保它们按照第11(a)条进行了保养,并仍然适合船舶的预定用途。
  (c)对本条之(a)(iii)和(a)(iv)中所述的定期检验和年度检验应在货船设备安全证书上签证。”
  第9条 货船无线电设备和雷达设备的检验

   “货船无线电设备的检验”

  “(a)第Ⅲ和Ⅳ章所适用的货船无线电设备(包括用于救生设备的无线电设备)应接受下列检验:
  (i)初次检验:在船舶投入营运前进行;
  (ii)换新检验:按主管机关规定的间隔期进行,但不得超过5年,第14(b)、(e)、(f)和(g)条所适用的情况除外;
  (iii)定期检验:在货船无线电安全证书每一周年日之前或之后3个月内进行;
  (iv)附加检验:与第7(b)(iii)条中对客船的规定相同。
  (b)本条之(a)中所述检验应按下列规定进行:
  (i)初次检验应包括对货船无线电设备(包括用于救生设备的无线电设备)的全面检查,以确保它们符合本规则的要求;
  (ii)换新检验和定期检验应包括对货船无线电设备(包括用于救生设备的无线电设备)的全面检查,以确保它们符合本规则的要求。
  (c)对本条之(a)(iii)中所述的定期检验应在货船无线电安全证书上签证。”
  第10条 货船船体、机器和设备的检验

   “货船结构、机器和设备的检验”
  本条的现有文字用下文替代:
  “(a)本条之(b)(i)中所述的货船结构、机器和设备(货船设备安全证书和货船无线电安全证书中的项目除外)应接受下列检验和检查:
  (i)初次检验:包括在船舶投入营运前对船底外部的检查;
  (ii)换新检验:按主管机关规定的间隔期进行,但不得超过5年,第14(b)、(e)、(f)和(g)条所适用的情况除外;
  (iii)期间检验:在货船构造安全证书的第二个周年日之前或之后3个月内进行,或者在该证书第三个周年日之前或之后3个月内进行。期间检验应取代本条之(a)(iv)中规定的某次年度检验;
  (iv)年度检验:在货船构造安全证书周年日之前或之后3个月内进行;
  (v)在每个5年期限中,应对船底外部至少检查两次,但第14(e)或(f)条所适用的情况除外。当第14(e)或(f)条适用时,可将5年期限延长,使之与经展期的证书的有效期相一致。在任何情况下,两次此种检查的间隔期不得超过36个月;
  (vi)附加检验:与第7(b)(iii)条中对客船的规定相同。
  (b)本条之(a)中所述的检验和检查应按下列规定进行:
  (i)初次检验应包括对结构、机器、结构用材尺寸和工艺、锅炉和其它受压容器及其附件、主机和辅机(包括操舵装置和有关控制系统在内)、电气设备和其它设备均符合本规则的要求,处于良好状况,适合该船的预定用途;并确保船舶备有所要求的稳性资料。对于液货轮,该检验不应包括对泵舱、液货、燃料和通风管系以及有关的安全装置的检查;
  (ii)换新检验应包括本条之(b)(i)中所述结构、机器和设备的检查,以确保它们符合本规则的要求,处于良好状况并适合船舶的预定用途;
  (iii)期间检验应包括对结构、锅炉及其它受压容器、机器和设备、操舵装置以及有关控制系统和电气设备的检查,以确保它们仍然适合船舶的预定用途。对于液货轮,该检验还应包括对泵舱、液货、燃料和通风管系以及有关的安全装置的检查和对危险区电气设备的绝缘阻抗的测量;
  (iv)年度检验应包括对本条之(b)(i)中所述的结构、机器和设备的全面检查,以确保它们按照第11(a)条进行了保养并仍然适合船舶的预定用途;
  (v)对船底外部的检查以及同时进行的对有关项目的检验应确保它们仍然适合船舶的预定用途。
  (c)对本条之(a)(iii)、(a)(iv)和(a)(v)中所述的期间检验、年度检验和对船底外部的检查应在货船构造安全证书上签证。”
  第11条 检验后状况的维持
  本条的现有文字用下文替代:
  “(a)应维持船舶及其设备的状况,使其符合本规则的各项规定,以保证该船在各方面继续适合出海航行而不致于对船舶及船上人员产生危险。
  (b)根据第7、8、9或10条的规定对船舶所进行的任何检验完成以后,非经主管机关许可,对已检验的结构布置、机器、设备及其他项目概不得变动。
  (c)当船舶发生事故或发现缺陷且在任一情况下都将影响该船的安全或影响该船救生设备或其它设备的有效性或完整性时,该船的船长或船东应尽快向负责签发有关证书的主管机关、指定的验船师或认可的组织报告。主管机关、指定的验船师或认可的组织在收到报告以后,应促成调查工作,以确定是否有必要进行第7、8、9或10条要求的检验。如该船系在另一缔约国政府的港口内,船长或船东亦应立即向港口国主管当局报告。指定的验船师或认可的组织应查明此报告是否业已递交。”
  第12条 证书的签发

   “证书的签发或签证”
  本条的现有文字用下文替代:
  “(a)(i)客船经过初次检验或换新检验,如符合第Ⅱ-1、Ⅱ-2、Ⅲ、Ⅳ和Ⅴ章的有关要求以及本规则的其它任何有关要求,应发给“客船安全证书”;
  (ii)货船经过初次检验或换新检验,如符合第Ⅱ-1和Ⅱ-2章的有关要求(与消防安全系统及设备和防火控制图有关的要求除外)以及本规则的其它任何有关要求,应发给“货船构造安全证书”;
  (iii)货船经过初次检验或换新检验,如符合第Ⅱ-1、Ⅱ-2、Ⅲ和Ⅴ章的有关要求以及本规则的任何其它有关要求,应发给“货船设备安全证书”;
  (iv)货船经过初次检验或换新检验,如符合第Ⅳ章的有关要求以及本规则的任何其它有关要求,应发给“货船无线电安全证书”;
  (v)(1)货船经过初次检验或换新检验,如符合第Ⅱ-1、Ⅱ-2、Ⅲ、Ⅳ和Ⅴ章的有关要求以及本规则的任何其它有关要求,可发给“货船安全证书”,用以替代本条之(a)(ii)、(a)(iii)和(a)(iv)中所述的证书;
  (2)当以货船安全证书来替代货船构造安全证书、货船设备安全证书或货船无线电安全证书时,本章中凡提及其中任何一种证书时,均应适用于货船安全证书。
  (vi)本条之(i)、(iii)、(iv)和(v)项中所述的客船安全证书、货船设备安全证书、货船无线电安全证书和货船安全证书应由设备记录簿加以补充;
  (vii)当根据和按照本规则的规定对船舶给予免除时,除上述的证书之外,还应向其签发“免除证书”;
  (viii)本条所述证书应由主管机关或由其授权的任何个人或组织签发或签证,在各种情况下,主管机关均应对证书承担全部责任。
  (b)在缔约国政府对本公约的接受生效之日以后,该政府不得再根据和按照1960年、1948年或1929年《国际海上人命安全公约》的规定签发证书。”
  第13条 他国政府代发证书
  现有标题用下文替代:
   “他国政府代发证书和签证”
  本条的现有文字用下文替代:
  “应主管机关的要求,缔约国政府可以促使船舶受到检验,如果认为该船符合本规则的要求,则应根据本规则向该船签发或授权向该船签发证书,并且,(如果适当的话)按照本规则对其证书进行签证或授权对其证书进行签证。以此种方法签发的证书应声明其系应船旗国政府要求签发,它与根据第12条签发的证书具有同等效力,并应得到同样的承认。”
  第14条 证书有效期限
  现有标题用下文替代:“证书的期限和有效性”
  本条的现有文字用下文替代:
  “(a)客船安全证书的有效期不得超过12个月,货船构造安全证书、货船设备安全证书和货船无线电安全证书应根据主管机关规定的期限签发,该期限不得超过5年。免除证书的有效期不得超过与其有关的证书的期限。
  (b)(i)不论本条之(a)有何要求,如果在原有证书失效日期之前3个月内完成了换新检验,则新证书的有效期为:
  (1)就客船而言,从换新检验完成之日起至从原有证书失效日期起算不得超过12个月的某个日期止;
  (2)就货船而言,从换新检验完成之日起至从原有证书失效日期起算不超过5年的某个日期止;
  (ii)如果换新检验是在原有证书的失效日期之后完成的,则新证书的有效期为:
  (1)就客船而言,从换新检验完成之日起至从原有证书失效日期起算不超过12个月的某个日期止;
  (2)就货船而言,从换新检验完成之日起至从原有证书失效日期起算不超过5年的某个日期止;
  (iii)如果换新检验是在原有证书失效日期的3个月前完成,则新证书的有效期为:
  (1)就客船而言,从换新检验完成之日起至从该日期起算不超过12个月的某个日期止;
  (2)就货船而言,从换新检验完成之日起至从该日期起算不超过5年的某个日期止。
  (c)如果客船安全证书以外的其它某种证书的有效期限短于5年,只要进行了第8、9和10条中适用于5年期限的证书的相应的检验,主管机关可以将该证书的有效期限展至本条之(a)中规定的最长期限。
  (d)如果已经完成了换新检验但在原有证书的失效日期之前不能签发新的证书或不能将新证书送到船上时,经主管机关授权的个人或组织可以对原有证书进行签证。此种证书展期的有效期限,从上述失效日期起算不得超过5个月。
  (e)如果证书失效时船舶不在其将接受检验的港口,主管机关可以延长证书的有效期,但是给予此种展期的目的仅仅是为了让船舶完成驶往检验港口的航次,而且只有在适当和合理时才能这样做。任何证书的展期不得超过3个月。获得展期的船舶在抵达检验港后,在没有取得新的证书前无权依据这种展期驶离该港口。在完成了换新检验后,新证书的失效日期为:
  (i)就客船而言,从原有证书未经展期前的失效日期起算不得超过12个月的某个日期;
  (ii)就货船而言,从原有证书未经展期前的失效日期起算不得超过5年的某个日期。
  (f)从事短程航行的船舶,其证书如未根据本条的上述规定加以展期,则主管机关可对证书进行展期,但不得超过从证书注明的失效日期起算的1个月的宽限期,在完成了换新检验后,新证书的失效日期为:
  (i)就客船而言,从原有证书未经展期前的失效日期起算不得超过12个月的某个日期;
  (ii)就货船而言,从原有证书未经展期前的失效日期起算不得超过5年的某个日期。
  (g)在由主管机关确定的特殊情况下,新证书的有效期不必从本条之(b)(ii)、(e)或(f)所要求的原有证书的失效日期起算。在此种特殊情况下,新证书的失效日期应为:
  (i)就客船而言,从完成换新检验之日起算不得超过12个月的某个日期;
  (ii)就货船而言,从完成换新检验之日起算不得超过5年的某个日期。  
  (h)如果年度检验、期间检验或定期检验是在有关规则规定的期限之前完成,则:
  (i)应通过签证将有关证书中标明的周年日期改为从完成检验之日起算不得超过3个月的某一日期;
  (ii)有关规则要求的而后的年度检验、期间检验或定期检验应使用新的周年日期并在这些规则所规定的间隔期内完成;
  (iii)如果视情进行了一次或多次年度检验、期间检验或定期检验而没有超过规则规定的最长的检验间隔期,则失效日期可以不变。
  (i)根据第12或13条签发的证书,在下述任何一种情况下,应不再有效:
  (i)有关的检验和检查没有在第7(a)、8(a)、9(a)、和10(a)条中规定的期限内完成;
  (ii)没有按照本规则对证书进行签证;
  (iii)船舶改挂另一国旗帜时,只有在签发新证书的政府认为船舶符合第11(a)和(b)条的要求时才能签发新证书。对于在缔约国之间变更船旗,如在变更船旗后的3个月内接到要求,前一船旗国政府应尽快将该船在变更船旗前所携证书的副本以及备存的检验报告送交该船的新的主管机关。”
  第15条 证书格式
  现有标题用下文替代:
   “证书和设备记录簿的格式”

  第19条 监督

  “(a)在另一缔约国政府港口内的每艘船舶都要接受该政府正式授权的官员为查明根据第12和13条签发的证书是否有效而进行的监督。
  (b)除非有明显理由认为船舶或其设备的状况在实质上与任何证书所载情况不符,或者船舶及其设备不符合第11(a)和(b)条的规定,此种证书,如属有效,则应得到承认。
  (c)在本条之(b)所述情况下,或在证书已经过期或失效时,执行监督的官员应采取措施保证,只有对船舶或船上人员不会造成危险时,船舶才能出海航行或离港驶往适当的修理厂。
  (d)当此种监督导致任何种类的干预时,执行监督的官员应立即将其认为必须进行干预的所有情况书面通知船旗国的领事;当领事不在时,则书面通知船旗国的最近的外交代表。此外,还应通知负责发证的指定的验船师或认可的组织。有关干预的实情应报告本组织。
  (e)如港口国当局未能按本条之(c)和(d)的规定采取行动,或已准许船舶驶往下一个停靠港,则除通知本条之(d)中所述的各方外,还应将该船舶的一切有关情况通知下一个停靠港的有关当局。
  (f)在实施本条的监督时,应尽一切努力避免船舶被不适当地滞留或延误。如果因此被不适当地滞留或延误,船舶有权对所受的任何损失或损害获得赔偿。”

PROTOCOL OF 1988 RELATING TO THE INTERNATIONAL CONVENTION FOR THE SAFETYOF LIFE AT SEA, 1974

THE PARTIES TO THE PRESENT PROTOCOL, BEING PARTIES to the InternationalConvention for the Safety of Life at Sea, done at London on 1 November
1974,

RECOGNIZING the need for the introduction into the above-mentioned
Convention of provisions for survey and certification harmonized with
corresponding provisions in other international instruments,

CONSIDERING that this need may best be met by the conclusion of a
Protocol relating to the International convention for the Safety of Lifeat Sea, 1974,

HAVE AGREED as follows:

ARTICLE I General obligations

1 The Parties to the present Protocol undertake to give effect to the
provisions of the present Protocol and Annex hereto, which shall
constitute an integral part of the present Protocol. Every reference to
the present Protocol constitutes at the same time a reference to the Annex
hereto.

2 As between the Parties to the present Protocol, the provisions of
the International Convention for the Safety of Life at Sea, 1974, as
amended, (hereinafter referred to as "the Convention") shall apply
subject to the modifications and additions set out in the present
Protocol.

3 With respect to ships entitled to fly the flag of a State which is
not a Party to the Convention and the present Protocol, the Parties to the
present Protocol shall apply the requirements of the Convention and the
present Protocol as may be necessary to ensure that no more favourable
treatment is given to such ships.

ARTICLE II Prior treaties

1 As between the Parties to the present Protocol, the present Protocol
replaces and abrogates the Protocol of 1978 relating to the Convention.

2 Notwithstanding any other provisions of the present Protocol, any
certificate issued under, and in accordance with, the provisions of theConvention and any supplement to such certificate issued under, and in
accordance with, the provisions of the Protocol of 1978 relating to the
Convention which is current when the present Protocol enters into force in
respect of the Party by which the certificate or supplement was issued,
shall remain valid until it expires under the terms of the Convention orthe Protocol of 1978 relating to the Convention, as the case may be.

3 A Party to the present Protocol shall not issue certificates under,
and in accordance with, the provisions of the International Convention for
the Safety of Life at Sea, 1974, as adopted on 1 November 1974.

ARTICLE III Communication of information

The Parties to the present Protocol undertake to communicate to, and
deposit with, the Secretary-General of the International Maritime
Organization (hereinafter referred to as "the Organization"):

(a) the text of laws, decrees, orders and regulations and other
instruments which have been promulgated on the various matters within the
scope of the present Protocol;

(b) a list of nominated surveyors or recognized organizations
which are authorized to act on their behalf in the administration of
measures for safety of life at sea for circulation to the Parties for
information of their officers, and a notification of the specific
responsibilities and conditions of the authority delegated to those
nominated surveyors or recognized organizations; and

(c) a sufficient number of specimens of their certificates issued
under the provision of the present Protocol.

ARTICLE IV Signature, ratification, acceptance, approval and ac-cession

1 The present Protocol shall be open for signature at the Headquarters
of the Organization from 1 March 1989 to 28 February 1990 and shall
thereafter remain open for accession. Subject to the provisions of
paragraph 3, States may express their consent to be bound by the presentProtocol by:

(a) signature without reservation as to ratification, acceptance
or approval; or

(b) signature subject to ratification, acceptance or approval,
followed by ratification, acceptance or approval; or

(c) accession.

2 Ratification, acceptance, approval or accession shall be effected by
the deposit of an instrument to that effect with the Secretary-General of
the Organization.

3 The present Protocol may be signed without reservation, ratified,
accepted, approved or acceded to only by States which have signed without
reservation, ratified, accepted, approved or acceded to the Convention.

ARTICLE V Enter into force

1 The present Protocol shall enter into force twelve months after the
date on which both the following conditions have been met:

(a) not less than fifteen States, the combined merchant fleets of
which constitute not less than fifty per cent of the gross tonnage of the
world's merchant shipping, have expressed their consent to be bound by it
in accordance with article IV, and

(b) the conditions for the entry into force of the Protocol of
1988 relating to the International Convention on Load Lines, 1966, have
been met,

provided that the present Protocol shall not enter into force before 1
February 1992.

2 For States which have deposited an instrument of ratification,
acceptance, approval or accession in respect of the present Protocol after
the conditions for entry into force thereof have been met but prior to the
date of entry into force, the ratification, acceptance, approval or
accession shall take effect on the date of entry into force of the present
Protocol or three months after the date of deposit of the instrument,
whichever is the later date.

3 Any instrument of ratification, acceptance, approval or accession
deposited after the date on which the present Protocol enters into forceshall take effect three months after the date of deposit.

4 After the date on which an amendment to the present Protocol is
deemed to have been accepted under article VI, any instrument of
ratification, acceptance, approval or accession deposited shall apply tothe present Protocol as amended.

ARTICLE VI Amendments

The procedures set out in article VIII of the Convention shall apply
to amendments to the present Protocol, provided that:

(a) references in that article to the Convention and to
Contracting Governments shall be taken to mean references to the presentProtocol and to the Parties to the present Protocol respectively;

(b) amendments to the articles of the present Protocol and to the
Annex thereto shall be adopted and brought into force in accordance withthe procedure applicable to amendments to the articles of the Conventionor to Chapter I of the Annex thereto; and

(c) amendments to the appendix to the Annex to the present
Protocol may be adopted and brought into force in accordance with the
procedure applicable to amendments to the Annex to the Convention other
than Chapter I.

ARTICLE VII Denunciation

1 The present Protocol may be denounced by any Party at any time after
the expiry of five years from the date on which the present Protocol
enters into force for that Party.

2 Denunciation shall be effected by the deposit of an instrument of
denunciation with the Secretary-General of the Organization.

3 A denunciation shall take effect one year, or such longer period as
may be specified in the instrument of denunciation, after its receipt bythe Secretary-General of the Organization.

4 A denunciation of the Convention by a Party shall be deemed to be a
denunciation of the present Protocol by that Party. Such denunciation
shall take effect on the same date as denunciation of the Convention takes
effect according to paragraph (c) of article XI of the Convention.

ARTICLE VIII Depositary

1 The present Protocol shall be deposited with the Secretary-General
of the Organization (hereinafter referred to as "the depositary").

2 The depositary shall:

(a) inform the Governments of all States which have signed the
present Protocol or acceded thereto of:

(i) each new signature or deposit of an instrument of
ratification, acceptance, approval or accession, together with the date
thereof;

(ii) the date of entry into force of the present Protocol;

(iii) the deposit of any instrument of denunciation of the
present Protocol together with the date on which it was received and thedate on which the denunciation takes effect;

(b) transmit certified true copies of the present Protocol to the
Governments of all States which have signed the present Protocol or
acceded thereto.

3 As soon as the present Protocol enters into force, a certified true
copy thereof shall be transmitted by the depositary to the Secretariat of
the United Nations for registration and publication in accordance with
Article 102 of the Charter of the United Nations.

ARTICLE IX Languages

The present Protocol is established in a single original in the
Arabic, Chinese, English, French, Russian and Spanish languages, each
text being equally authentic. An official translation into the Italian
language shall be prepared and deposited with the signed original.

DONE AT LONDON this eleventh day of November one thousand nine hundred

ANNEX: MODIFICATIONS AND ADDITIONS TO THE ANNEX TO THE INTERNATIONAL
CONVENTION FOR THE SAFETY OF LIFE AT SEA, 1974

CHAPTER I GENERAL PROVISIONS

PART A APPLICATION, DEFINITIONS, ETC.

Regulation 2 Definitions

The existing text of paragraph (k) is replaced by the following:

"(k) New ship means a ship the keel of which is laid or which is at a
similar stage of construction on or after 25 May 1980."

The following paragraph is added to the existing text:

"(n) Anniversary date means the day and the month of each year which
will correspond to the date of expiry of the relevant certificate."

PART B SURVEYS AND CERTIFICATES

Regulation 6 Inspection and survey

The existing text is replaced by the following:

"(a) The inspection and survey of ships, so far as regards the
enforcement of the provisions of the present regulations and the granting
of exemptions therefrom, shall be carried out by officers of the
Administration. The Administration may, however, entrust the inspectionsand surveys either to surveyors nominated for the purpose or to
organizations recognized by it.

(b) An Administration nominating surveyors or recognizing
organizations to conduct inspections and surveys as set forth in paragraph
(a) shall as a minimum empower any nominated surveyor or recognized
organization to:

(i) require repairs to a ship;

(ii) carry out inspections and surveys if requested by the
appropriate authorities of a port State.

The Administration shall notify the Organization of the specific
responsibilities and conditions of the authority delegated to nominated
surveyors or recognized organizations.

(c) When a nominated surveyor or recognized organization determines
that the condition of the ship or its equipment does not correspond
substantially with the particulars of the certificate or is such that the
ship is not fit to proceed to sea without danger to the ship, or personson board, such surveyor or organization shall immediately ensure that
corrective action is taken and shall in due course notify the
Administration. If such corrective action is not taken the relevant
certificate should be withdrawn and the Administration shall be notifiedimmediately; and, if the ship is in the port of another Party, the
appropriate authorities of the port State shall also be notified
immediately. When an officer of the Administration, a nominated surveyoror a recognized organization has notified the appropriate authorities ofthe port State, the Government of the port State concerned shall give such
officer, surveyor or organization any necessary assistance to carry out
their obligations under this regulation. When applicable, the Governmentof the port State concerned shall ensure that the ship shall not sail
until it can proceed to sea, or leave port for the purpose of proceedingto the appropriate repair yard, without danger to the ship or persons onboard.

(d) In every case, the Administration shall fully guarantee the
completeness and efficiency of the inspection and survey, and shall
undertake to ensure the necessary arrangements to satisfy this
obligation."

Regulation 7 Surveys of passenger ships

The existing text is replaced by the following:

"(a) A passenger ship shall be subject to the surveys specified below:

(i) an initial survey before the ship is put in service;

(ii) a renewal survey once every 12 months, except where
regulation 14(b), (e), (f) and (g) is applicable;

(iii) additional surveys, as occasion arises.

(b) The surveys referred to above shall be carried out as follows:

(i) the initial survey shall include a complete inspection of the
ship's structure, machinery and equipment, including the outside of the
ship's bottom and the inside and outside of the boilers. This survey shall
be such as to ensure that the arrangements, materials and scantlings of
the structure, boilers and other pressure vessels and their appurtenances,
main and auxiliary machinery, electrical installation, radio
installations including those used in life-saving appliances, fire
protection, fire safety systems and appliances, life-saving appliances and
arrangements, shipborne navigational equipment, nautical publications,means of embarkation for pilots and other equipment fully comply with the
requirements of the present regulations, and of the laws, decrees, orders
and regulations promulgated as a result thereof by the Administration for
ships of the service for which it is intended. The survey shall also be
such as to ensure that the workmanship of all parts of the ship and its
equipment is in all respects satisfactory, and that the ship is provided
with the lights, shapes, means of making sound signals and distress
signals as required by the provisions of the present regulations and theInternational Regulations for Preventing collisions at Sea in force;

(ii) the renewal survey shall include an inspection of the
structure, boilers and other pressure vessels, machinery and equipment,
including the outside of the ship's bottom. The survey shall be such as to
ensure that the ship, as regards the structure, boilers and other pressure
vessels and their appurtenances, main and auxiliary machinery, electrical
installation, radio installations including those used in life-saving
appliances, fire protection, fire safety systems and appliances,
life-saving appliances and arrangements, shipborne navigational equipment,
nautical publications, means of embarkation for pilots and other equipment
is in satisfactory condition and is fit for the service for which it is
intended, and that it complies with the requirements of the present
regulations and of the laws, decrees, orders and regulations promulgatedas a result thereof by the Administration. The lights, shapes, means of
making sound signals and distress signals carried by the ship shall alsobe subject to the above-mentioned survey for the purpose of ensuring that
they comply with the requirements of the present regulations and of the
International Regulations for Preventing Collisions at Sea in force;

(iii) an additional survey either general or partial, according to
the circumstances, shall be made after a repair resulting from
investigations prescribed in regulation 11, or whenever any important
repairs or renewals are made. The survey shall be such as to ensure thatthe necessary repairs or renewals have been effectively made, that the
material and workmanship of such repairs or renewals are in all respectssatisfactory, and that the ship complies in all respects with the
provisions of the present regulations and of the International Regulations
for Preventing Collisions at Sea in force, and of the laws, decrees,
orders and regulations promulgated as a result thereof by the
Administration;

(c) (i) the laws, decrees, orders and regulations referred to in
paragraph (b) of this regulation shall be in all respects such as to
ensure that, from the point of view of safety of life, the ship is fit for
the service for which it is intended;

(ii) they shall among other things prescribe the requirements to
be observed as to the initial and subsequent hydraulic or other acceptable
alternative tests to which the main and auxiliary boilers, connections,
steam pipes, high pressure receivers and fuel tanks for internal
combustion engines are to be submitted including the test procedures to be
followed and the intervals between two consecutive tests."

Regulation 8 Surveys of life-saving appliances and other 
equipmentofcargo ships

The existing text is replaced by the following:

"(a) The life-saving appliances and other equipment of cargo ships of
500 tons gross tonnage and upwards as referred to in paragraph (b) (i)
shall be subject to the surveys specified below:

(i) an initial survey before the ship is put in service;

(ii) a renewal survey at intervals specified by the Administration
but not exceeding 5 years, except where regulation 14(b), (e), (f) and (g)
is applicable;

(iii) a periodical survey within three months before or after the
second anniversary date or within three months before or after the thirdanniversary date of the Cargo Ship Safety Equipment Certificate which
shall take the place of one of the annual surveys specified in paragraph(a) (iv);

(iv) an annual survey within three months before or after each
anniversary date of the Cargo Ship Safety Equipment Certificate;

(v) an additional survey as prescribed for passenger ships in
regulation 7 (b) (iii).

(b) The surveys referred to in paragraph (a) shall be carried out as
follows:

(i) the initial survey shall include a complete inspection of the
fire safety systems and appliances, life-saving appliance and
arrangements except radio installations, the shipborne navigational
equipment, means of embarkation for pilots and other equipment to which
chapters II-1, II-2, II and V apply to ensure that they comply with the
requirements of the present regulations, are in satisfactory condition and
are fit for the service for which the ship is intended. The fire controlplans, nautical publications, lights, shapes, means of making sound
signals and distress signals shall also be subject to the above-mentioned
survey for the purpose of ensuring that they comply with the requirements
of the present regulations and, where applicable, the International
Regulations for Preventing Collisions at Sea in force;

(ii) the renewal and periodical surveys shall include an
inspection of the equipment referred to in paragraph (b) (i) to ensure
that it complies with the relevant requirements of the present regulations
and the International Regulations for Preventing Collisions at Sea in
force, is in satisfactory condition and is fit for the service for whichthe ship is intended;

(iii) the annual survey shall include a general inspection of the
equipment referred to in paragraph (b) (i) to ensure that it has been
maintained in accordance with regulation 11 (a) and that it remains
satisfactory for the service for which the ship is intended.

(c) The periodical and annual surveys referred to in paragraphs (a)
(iii) and (a) (iv) shall be endorsed on the Cargo Ship Safety Equipment
Certificate."

Regulation 9 Surveys of radio and radar installations of cargoships

The existing heading is replaced by the following: "Surveys of radio
installations of cargo ships"

The existing text is replaced by the following:

"(a) The radio installations, including those used in life-saving
appliances, of cargo ships to which chapters III and IV apply shall be
subject to the surveys specified below:

(i) an initial survey before the ship is put in service;

(ii) a renewal survey at intervals specified by the Administration
but not exceeding five years, except where regulation 14(b), (e), (f) and
(g) is applicable;

(iii) a periodical survey within three months before or after each
anniversary date of the Cargo Ship Safety Radio Certificate;

(iv) an additional survey as prescribed for passenger ships in
regulation 7 (b) (iii).

(b) The surveys referred to in paragraph (a) shall be carried out as
follows:

(i) the initial survey shall include a complete inspection of the
radio installations of cargo ships, including those used in life-saving
appliances, to ensure that they comply with the requirements of the
present regulations.

(ii) the renewal and periodical surveys shall include an
inspection of the radio installations of cargo ships, including those used
in life-saving appliances, to ensure that they comply with the
requirements of the present regulations.

(c) The periodical surveys referred to in paragraph (a) (iii) shall be
endorsed on the Cargo Ship Safety Radio Certificate."

Regulation 10 Surveys of hull, machinery and equipment of cargoships

The existing heading is replaced by the following: "Surveys of
structure, machinery and equipment of cargo ships"

The existing text is replaced by the following:

"(a) The structure, machinery and equipment (other than items in
respect of which a Cargo Ship Safety Equipment Certificate and a Cargo
Ship Safety Radio Certificate are issued) of a cargo ship as referred toin paragraph (b) (i) shall be subject to the surveys and inspections
specified below:

(i) an initial survey including an inspection of the outside of
the ship's bottom before the ship is put in service;

(ii) a renewal survey at intervals specified by the Administration
but not exceeding 5 years, except where regulation 14(b), (e), (f) and (g)
is applicable;

(iii) an intermediate survey within three months before or after
the second anniversary date or within three months before or after the
third anniversary date of the Cargo Ship Safety Construction Certificate,
which shall take the place of one of the annual surveys specified in
paragraph (a) (iv);

(iv) an annual survey within three months before or after each
anniversary date of the Cargo Ship Safety Construction Certificate;

(v) a minimum of two inspections of the outside of the ship's
bottom during any five year period, except where regulation 14 (e) or (f)
is applicable. Where regulation 14 (e) or (f) is applicable, this five
year period may be extended to coincide with the extended period of
validity of the certificate. In all cases the interval between any two
such inspections shall not exceed 36 months;

(vi) an additional survey as prescribed for passenger ships in
regulation 7 (b) (iii).

(b) The surveys and inspections referred to in paragraph (a) shall be
carried out as follows:

(i) the initial survey shall include a complete inspection of the
structure, machinery and equipment. This survey shall be such as to ensure
that the arrangements, materials, scantlings and workmanship of the
structure, boilers and other pressure vessels, their appurtenances, main
and auxiliary machinery including steering gear and associated control
systems, electrical installation and other equipment comply with the
requirements of the present regulations, are in satisfactory condition and
are fit for the service for which the ship is intended and that the
required stability information is provided. In the case of tankers such a
survey shall also include an inspection of the pump-rooms, cargo, bunkerand ventilation piping systems and associated safety devices;

(ii) the renewal survey shall include an inspection of the
structure, machinery and equipment as referred to in paragraph (b) (i) to
ensure that they comply with the requirements of the present regulations,
are in satisfactory condition and are fit for the service for which the
ship is intended;

(iii) the intermediate survey shall include an inspection of the
structure, boilers and other pressure vessels, machinery and equipment,
the steering gear and the associated control systems and electrical
installations to ensure that they remain satisfactory for the service for
which the ship is intended. In the case of tankers, the survey shall also
include an inspection of the pump-rooms, cargo bunker and ventilation
piping systems and associated safety devices and the testing of insulation
resistance of electrical installations in dangerous zones;

(iv) the annual survey shall include a general inspection of the
structure, machinery and equipment referred to in paragraph (b) (i), to
ensure that they have been maintained in accordance with regulation 11 (a)
and that they remain satisfactory for the service for which the ship is
intended;

(v) the inspection of the outside of the ship's bottom and the
survey of related items inspected at the same time shall be such as to
ensure that they remain satisfactory for the service for which the ship is
intended.

(c) The intermediate and annual surveys and the inspections of the
outside of the ship's bottom referred to in paragraphs (a) (iii), (a) (iv)
and (a) (v) shall be endorsed on the Cargo Ship Safety Construction
Certificate."

Regulation 11 Maintenance of conditions after survey

The existing text is replaced by the following:

"(a) The condition of the ship and its equipment shall be maintained
to conform with the provisions of the present regulations to ensure thatthe ship in all respects will remain fit to proceed to sea without danger
to the ship or persons on board.

(b) After any survey of the ship under regulations 7, 8, 9 of 10 has
been completed, no change shall be made in the structural arrangements,
machinery, equipment and other items covered by the survey, without the
sanction of the Administration.

(c) Whenever an accident occurs to a ship or a defect is discovered,
either of which affects the safety of the ship or the efficiency or
completeness of its life-saving appliances or other equipment, the master
or owner of the ship shall report at the earliest opportunity to the
Administration, the nominated surveyor or recognized organization
responsible for issuing the relevant certificate, who shall cause
investigations to be initiated to determine whether a survey, as required
by regulations 7, 8, 9 or 10, is necessary. If the ship is in a port of
another Contracting Government, the master or owner shall also report
immediately to the appropriate authorities of the port State and the
nominated surveyor or recognized organization shall ascertain that such a
report has been made."

Regulation 12 Issue of certificates

The existing heading is replaced by the following: "Issue or
endorsement of certificates"

The existing text is replaced by the following:

"(a) (i) a certificate called a Passenger ship Safety Certificate
shall be issued after an initial or renewal survey to a passenger ship
which complies with the relevant requirements of chapters II-1, II-2, III,
IV and V and any other relevant requirements of the present regulations;
(ii) a certificate called a Cargo Ship Safety Construction
Certificate shall be issued after an initial or renewal survey to a cargo
ship which complies with the relevant requirements of chapters II-1 and
II-2 (other than those relating to fire safety systems and appliances and
fire control plans) and any other relevant requirements of the present
regulations;

(iii) a certificate called a Cargo Ship Safety Equipment
Certificate shall be issued after an initial or renewal survey to a cargo
ship which complies with the relevant requirements of chapters II-1, II-2,
III and V and any other relevant requirements of the present regulations;

(iv) a certificate called a Cargo Ship Safety Radio Certificate
shall be issued after an initial or renewal survey to a cargo ship whichcomplies with the relevant requirements of chapter IV and any other
relevant requirements of the present regulations;

(v) (1) a certificate called a Cargo Ship Safety Certificate may
be issued after an initial or renewal survey to a cargo ship which
complies with the relevant requirements of chapters II-1, II-2, III, IV
and V and any other relevant requirements of the present regulations, asan alternative to the certificates referred to in paragraph (a) (ii), (a)
(iii) and (a) (iv);

(2) whenever in this chapter reference is made to a Cargo Ship
Safety Construction Certificate, Cargo Ship Safety Equipment Certificateor Cargo Ship Safety Radio Certificate, it shall apply to a Cargo Ship
Safety Certificate, if it is used as an alternative to these certificates.

(vi) the Passenger Ship Safety Certificate, the Cargo Ship Safety
Equipment Certificate, the Cargo Ship Safety Radio Certificate and the
Cargo Ship Safety Certificate, referred to in subparagraphs (i), (iii),(iv) and (v), shall be supplemented by a Record of Equipment;

(vii) when an exemption is granted to a ship under and in
accordance with the provisions of the present regulations, a certificatecalled an Exemption Certificate shall be issued in addition to the
certificates prescribed in this paragraph;

(viii) the certificates referred to in this regulation shall be
issued or endorsed either by the Administration or by any person or
organization authorized by it. In every case, that Administration assumes
full responsibility for the certificates.

(b) A Contracting Government shall not issue certificates under, and
in accordance with, the provisions of the International Convention for
the Safety of Life at Sea, 1960, 1948 or 1929, after the date on which
acceptance of the present Convention by the Government takes effect."

Regulation 13 Issue of certificate by another Government

The existing heading is replaced by the following: "Issue or
endorsement of certificates by another Government"

The existing text is replaced by the following:

"A Contracting Government may, at the request of the Administration,
cause a ship to be surveyed and, if satisfied that the requirements of the
present regulations are complied with, shall issue or authorize the issue
of certificates to the ship and, where appropriate, endorse or authorizethe endorsement of certificates on the ship in accordance with the present
regulations. Any certificate so issued shall contain a statement to the
effect that it has been issued at the request of the Government of the
State the flag of which the ship is entitled to fly, and it shall have the
same force and receive the same recognition as a certificate issued under
regulation 12."

Regulation 14 Duration of certificates

The existing heading is replaced by the following: "Duration and
validity of certificates"

The existing text is replaced by the following:

"(a) A Passenger Ship Safety Certificate shall be issued for a period
not exceeding 12 months. A Cargo Ship Safety Construction Certificate,
Cargo Ship Safety Equipment Certificate and Cargo Ship Safety Radio
Certificate shall be issued for a period specified by the Administrationwhich shall not exceed five years. An Exemption Certificate shall not bevalid for longer than the period of the certificate to which it refers.

(b) (i) notwithstanding the requirements of paragraph (a), when the
renewal survey is completed within three months before the expiry date of
the existing certificate, the new certificate shall be valid from the date
of completion of the renewal survey to:

(1) for a passenger ship, a date not exceeding 12 months from
the date of expiry of the existing certificate;

(2) for a cargo ship, a date not exceeding five years from the
date of expiry of the existing certificate;

(ii) when the renewal survey is completed after the expiry date of
the existing certificate, the new certificate shall be valid from the
date of completion of the renewal survey to:

(1) for a passenger ship, a date not exceeding 12 months from
the date of expiry of the existing certificate;

(2) for a cargo ship, a date not exceeding five years from the
date of expiry of the existing certificate;

(iii) when the renewal survey is completed more than three months
before the expiry date of the existing certificate, the new certificate
shall be valid from the date of completion of the renewal survey to:

(1) for a passenger ship, a date not exceeding 12 months from
the date of completion of the renewal survey;

(2) for a cargo ship, a date not exceeding five years from the
date of completion of the renewal survey.

(c) If a certificate other than a Passenger Ship Safety Certificate
is issued for a period of less than five years, the Administration may
extend the validity of the certificate beyond the expiry date to the
maximum period specified in paragraph (a), provided that the surveys
referred to in regulations 8, 9 and 10 applicable when a certificate is
issued for a period off years are carried out as appropriate.

(d) If a renewal survey has been completed and a new certificate
cannot be issued or placed on board the ship before the expiry date of the
existing certificate, the person or organization authorized by the
Administration may endorse the existing certificate and such a certificate
shall be accepted as valid for a further period which shall not exceed 5months from the expiry date.

(e) If a ship at the time when a certificate expires is not in a port
in which it is to be surveyed, the Administration may extend the periodof validity of the certificate but this extension shall be granted only
for the purpose of allowing the ship to complete its voyage to the port in
which it is to be surveyed, and then only in cases where it appears proper
and reasonable to do so. No certificate shall be extended for a period
longer than three months, and a ship to which an extension is granted
shall not, on its arrival in the port in which it is to be surveyed, be
entitled by virtue of such extension to leave that port without having anew certificate. When the renewal survey is completed, the new certificate
shall be valid to:

(i) for a passenger ship, a date not exceeding 12 months from the
date of expiry of the existing certificate before the extension was
granted;

(ii) for a cargo ship, a date not exceeding 5 years from the date
of expiry of the existing certificate before the extension was granted.

(f) A certificate issued to a ship engaged on short voyages which has
not been extended under the foregoing provisions of this regulation may be
extended by the Administration for a period of grace of up to one month
from the date of expiry stated on it. When the renewal survey is
completed, the new certificate shall be valid to:

(i) for a passenger ship, a date not exceeding 12 months from the
date of expiry of the existing certificate before the extension was
granted;

(ii) for a cargo ship, a date not exceeding 5 years from the date
of expiry of the existing certificate before the extension was granted.

(g) In special circumstances, as determined by the Administration, a
new certificate need not be dated from the date of expiry of the existing
certificate as required by paragraphs (b) (ii), (e) or (f). In these
special circumstances, the new certificate shall be valid to:

(i) for a passenger ship, a date not exceeding 12 months from the
date of completion of the renewal survey;

(ii) for a cargo ship, a date not exceeding five years from the
date of completion of the renewal survey.

(h) If an annual, intermediate or periodical survey is completed
before the period specified in the relevant regulations then:

(i) the anniversary date shown on the relevant certificate shall
be amended by endorsement to a date which shall not be more than three
months later than the date on which the survey was completed;

(ii) the subsequent annual, intermediate or periodical survey
required by the relevant regulations shall be completed at the intervalsprescribed by these regulations using the new anniversary date;

(iii) the expiry date may remain unchanged provided one or more
annual, intermediate or periodical surveys, as appropriate, are carried
out so that the maximum intervals between the surveys prescribed by the
relevant regulations are not exceeded.

(i) A certificate issued under regulation 12 or 13 shall cease to be
valid in any of the following cases:

(i) if the relevant surveys and inspections are not completed
within the periods specified under regulations 7(a), 8(a), 9(a) and 10
(a);

(ii) if the certificate is not endorsed in accordance with the
present regulations;

(iii) upon transfer of the ship to the flag of another State. A
new certificate shall only be issued when the Government issuing the newcertificate is fully satisfied that the ship is in compliance with the
requirements of regulation 11 (a) and (b). In the case of a transfer
between Contracting Governments, if requested within three months after
the transfer has taken place, the Government of the State whose flag theship was formerly entitled to fly shall, as soon as possible, transmit to
the Administration copies of the certificates carried by the ship beforethe transfer and, if available, copies of the relevant survey reports."

Regulation 15 Form of certificates

"The certificates and records of equipment shall be drawn up in the
form corresponding to the models given in the appendix to the Annex to the
present Convention. If the language used is neither English nor French,
the text shall include a translation into one of these languages."

Regulation 16 Posting up of certificates

The existing heading is replaced by the following: "Availability of
certificates"

The existing text is replaced by the following:

"The certificates issued under regulations 12 and 13 shall be readily
available on board for examination at all times."

Regulation 19 Control

The existing text is replaced by the following:

"(a) Every ship when in a port of another Contracting Government is
subject to control by officers duly authorized by such Government in so
far as this control is directed towards verifying that the certificates
issued under regulation 12 or regulation 13 are valid.

(b) Such certificates, if valid, shall be accepted unless there are
clear grounds for believing that the condition of the ship or of its
equipment does not correspond substantially with the particulars of any of
the certificates or that the ship and its equipment are not in compliance
with the provisions of regulation 11 (a) and (b).

(c) In the circumstances given in paragraph (b) or where a certificate
has expired or ceased to be valid, the officer carrying out the control
shall take steps to ensure that the ship shall not sail until it can
proceed to sea or leave the port for the purpose of proceeding to the
appropriate repair yard without danger to the ship or persons on board.

(d) In the event of this control giving rise to an intervention of any
kind, the officer carrying out the control shall forthwith inform, in
writing, the consul or, in his absence, the nearest diplomatic
representative of the State whose flag the ship is entitled to fly of all
the circumstances in which intervention was deemed necessary. In addition,
nominated surveyors or recognized organizations responsible for the issue
of the certificates shall also be notified. The facts concerning the
intervention shall be reported to the Organization.

(e) The port State authority concerned shall notify all relevant
information about the ship to the authorities of the next port of call, in
addition to parties mentioned in paragraph (d), if it is unable to takeaction as specified in paragraphs (c) and (d) or if the ship has been
allowed to proceed to the next port of call.

(f) When exercising control under this regulation all possible efforts
shall be made to avoid a ship being unduly detained or delayed. If a ship
is thereby unduly detained or delayed it shall be entitled to compensation
for any loss or damage suffered."
