  The "Measures for the Administration of Metrological Benchmarks", which were deliberated and adopted at the utive meeting of the General Administration of Quality Supervision, Inspection and Quarantine on May 30, 2007, are hereby promulgated, and shall come into force on July 10, 2007. The "Measures for the Administration of Metrological Benchmarks" promulgated by the former State Metrology Bureau on July 10, 1987 shall be repealed simultaneously.

Measures on the Administration of Metrological Benchmarks

  Article 1 The present Measures are formulated in accordance with the relevant provisions of the "Metrology Law of the People's Republic of China" and the "Detailed Rules for the Implementation of the Metrology Law of the People's Republic of China" for the purpose of strengthening the administration of metrological benchmarks.

  Article 2 The term "metrological benchmark" as mentioned in the present Measures shall refer to a physical measuring tool, measuring apparatus, standard substance or measuring system which is approved by the General Administration of Quality Supervision, Inspection and Quarantine (hereinafter referred to as the GAQSIQ) and be used within the territory of the People's Republic of China as the basis for determining the measurement standard of the relevant quantity for the purpose of defining, realizing, preserving or reflecting the unit of the quantity or one or more values of quantity.

  Article 3 The establishment, preservation, maintenance, reform, use and abolishment of metrological benchmarks within the territory of the People's Republic of China shall be governed by the present Measures.

  Article 4 Metrological benchmarks shall, when required by social and economic development as well as scientific and technological progress, be organized and established by the GAQSIQ on the basis of uniform planning.

  Basic and common metrological benchmarks shall be established in the technical institution of metrology set up or authorized by the GAQSIQ; the metrological benchmarks with strong professionality which are only needed in very few industries, or the metrological benchmarks whose working conditions have particular requirements may be established in the technical institution of metrology subordinate to the relevant department or entity.

  To establish a metrological benchmark, the corresponding technical institution of metrology may file an application to the GAQSIQ.

  Article 5 A technical institution of metrology must, when applying for a metrological benchmark, submit it to the GAQSIQ for approval according to the prescribed conditions and procedures.

  Article 6 A technical institution of metrology that applies for a metrological benchmark shall meet the following conditions:

  (1) Being able to bear legal liabilities independently;

  (2) Having full-time technicians and managers who are engaged in the research, preservation, maintenance, use or reform, etc. of metrological benchmarks;

  (3) Having the devices for preserving, maintaining and reforming metrological benchmarks and the laboratory environment for normal work (including working place, temperature, moisture, anti-dust, anti-vibration, anticorrosion, anti-jamming, etc.);

  (4) Having the expenses and technical guarantee capacity needed for ensuring the value of quantity of the metrological benchmark to repeat at regular intervals and keeping the metrological benchmark to operate reliably and stably on the long-term basis;

  (5) Having a corresponding quality management system; and

  (6) Having a dominating laboratory for participating in international comparison and undertaking domestic comparison as well as the technical level for forwarding the value of quantity.

  Article 7 A technical institution of metrology that applies for a metrological benchmark shall provide the GAQSIQ with the following documents:

  (1) the application report;

  (2) the study report;

  (3) the report on the scientific and technological authentication presided over or recognized by the relevant competent department at the provincial or ministerial level or above, and corresponding proof documents;

  (4) the assessment report on the trial run period, and the reflectibility and annual stability operation records;

  (5) the verification system program;

  (6) the metrological benchmark manual; and

  (7) the schedule of the principal equipment and accessory equipment, as well as the photocopy materials.

  Article 8 The GAQSIQ may entrust an expert panel to make examination and on-site appraisal of the documents and materials of the metrological benchmark for which the technical institution of metrology applies, and the expert panel shall issue an appraisal report.

  The examination of the documents and materials as well as the contents of the on-site appraisal shall meet the requirements prescribed in Articles 6 and 7 of the present Measures.

  Article 9 The GAQSIQ shall check the expert appraisal report; and shall, if the report is found qualified from the check, approve the application for establishing a metrological benchmark, issue metrological benchmark certificates, and make an announcement to the public.

  An approved metrological benchmark shall be preserved and maintained by the technical institution of metrology that applies for it, and the laboratory for preserving and maintaining the metrological benchmarks shall be a national laboratory of metrological benchmarks.

  Article 10 A technical institution of metrology that preserves and maintains metrological benchmarks shall warrant to continuously meet the conditions prescribed in Article 6.

  Article 11 A technical institution of metrology that preserves and maintains metrological benchmarks shall carry out the following activities at regular or irregular intervals:

  (1) Eliminating various hidden troubles which might cause accidents so as to avoid inaccuracy of the metrological benchmark;

  (2) Taking part in international comparison, and guaranteeing the value of quantity of the metrological benchmark to be stable and to be consistent with the international equivalence of the value of quantity; and

  (3) Repeating the value of quantity of the metrological benchmark unit at regular intervals.

  The technical institution of metrology shall timely report the relevant information on the activities prescribed in the preceding paragraph to the GAQSIQ.

  Article 12 A technical institution of metrology shall not unlawfully reform or dismantle a metrological benchmark; if it needs to be reformed or dismantled, it shall be reported to the GAQSIQ for approval.

  Article 13 Where, after a metrological benchmark has been reformed or dismantled and has passed the stability operation experiment, the said metrological benchmark needs to be restored, the technical institution of metrology shall report to the GAQSIQ for approval.

  The application and approval concerning the matters prescribed in the preceding paragraph shall be governed by Articles 7 through 9 of the present Measures.

  Article 14 Where the value of a metrological benchmark is changed or the metrological benchmark is changed due to the change of the corresponding metrological unit, the technical institution of metrology shall report to the GAQSIQ for approval.

  Article 15 A technical institution of metrology shall check the technical conditions of the metrological benchmark at regular intervals, guarantee that the metrological benchmark work normally, and make use of the metrological benchmark for forwarding the value of quantity according to the requirements of the norms.

  Where the forwarding of the value of quantity of a metrological benchmark is discontinued due to a certain reason, the technical institution of metrology shall report it to the GAQSIQ.

  Article 16 The GAQSIQ and the relevant competent department in charge of the technical institution of metrology for preserving and maintaining the metrological benchmarks shall strengthen their contribution of funds to the preservation, maintenance and reform of metrological benchmarks.

  Article 17 The GAQSIQ shall timely abolish the metrological benchmarks which do not adapt to the needs in metrological work or whose technological level is lagged behind, revoke their original metrological benchmark certificates, and make announcements to the public.

  Article 18 The GAQSIQ may make regular reviews on irregular supervision and inspections of metrological benchmarks, and the period of review shall generally be 5 years.

  The contents for reviews, supervision and inspections shall include: the technical state and operational status of the metrological benchmarks, the forwarding of values of quantity, the staff, the environmental conditions, the quality system, the guarantee of expenses and the technological guarantee conditions, etc.

  The GAQSIQ may, on the basis of the results of reviews, supervision and inspections, organize or order relevant technical institution of metrology to rectify relevant metrological benchmarks.

  Article 19 A technical institution of metrology which is engaged in preservation, maintenance or use of metrological benchmarks or any of its employees shall not commit any of the following facts:

  (1) Making use of metrological benchmarks to carry out illegitimate activities;

  (2) Failing to implement the relevant bylaws on report and approval of metrological benchmarks;

  (3) Intentionally damaging metrological benchmark equipment, thus causing the value of quantity of the metrological benchmark to be inaccurate, stopped from use or discarded as useless;

  (4) Improper operation, failing to perform or correctly perform relevant duties, thus causing the metrological benchmark to be inaccurate, stopped from use or discarded as useless;

  (5) Intentionally tampering or forging any data, report, certificate or technical archives, etc.;

  (6) Improperly dealing with, calculating or recording data, thus causing the report and certificate to be erroneous.

  Where a technical institution of metrology or any of its staff violates the preceding paragraph, the said institution shall be ordered by the GAQSIQ to make a rectification within a time limit; if the circumstances are serious, its metrological benchmark certificate and the title of national metrological benchmark laboratory shall be revoked, and the relevant persons held liable shall be given administrative sanctions; if a crime is constituted, the offender shall be subject to criminal liabilities in accordance with law.

  Article 20 Where a state functionary who is engaged in metrological benchmark administration abuses his powers, neglects his duties, or resorts to deception for personal gains, with the circumstance being slight, he shall be given administrative sanctions in accordance with law; if a crime is constituted, he shall be subject to criminal liabilities in accordance with law.

  Article 21 The power and responsibility to interpret the present Measures shall remain with the GAQSIQ.

  Article 22 The present Measures shall come into force on July 10, 2007. The "Measures on the Administration of Metrological Benchmarks" promulgated by the former State Metrology Bureau on July 10, 1987 shall be repealed simultaneously.
