　　关于当事人对工伤认定不服申请行政复议问题的复函

重庆市劳动和社会保障局：
　　你局关于当事人对工伤认定不服申请行政复议问题的紧急请示（渝劳社文〔2004〕48号）
收悉。经研究，现答复如下：
　　按照《工伤保险条例》第五十三条规定，申请工伤认定的职工或者直系亲属、该职工所
在单位对工伤认定结论不服的，应该首先申请行政复议，对行政复议决定不服的，再依法提
起行政诉讼。
　　在适用《工伤认定办法》第十九条规定时，当事人对工伤认定结论不服的，应依照《工
伤保险条例》第五十三条规定执行；当事人对不予受理决定不服的，可以依法申请行政复议
或者提起行政诉讼，即这种情况下行政复议不是前置程序。
