骗子借买卖古币设局 三轮车司机贪小利被骗

三名骗子以买卖古钱币为名设下连环骗局，专门诈骗三轮车司机钱财。11月9日，江苏省徐州市泉山法院一审认定三被告人犯诈骗罪，判处被告人王平有期徒刑二年六个月，并处罚金10000元，判处被告人许立有期徒刑二年二个月，并处罚金5000元，判处被告人许新明有期徒刑二年，并处罚金5000元。    2012年5月至6月间，被告人王平、许立、许新明经事先预谋，由被告人许新明乘坐三轮出租车假装找被告人王平联系购买古钱币，被告人王平再乘坐该三轮出租车假装找古钱币出售者许立购买古钱币。被告人王平以自己所带现金不够为由，向三轮出租车驾驶员借款，同时许以高额利润提成。待驾驶员将现金等财物交付后，三被告人携带所骗财物伺机逃离。在不到两个月的时间里，三人共实施诈骗四起，骗取财物52268元。
    泉山法院审理后认为，三被告人以非法占有为目的，虚构事实，骗取公民财物，数额较大，其行为已构成诈骗罪。被告人王平、许立因诈骗多次被劳动教养，酌情予以从重处罚。被告人许立、许新明到案后如实供述自己及同案人的罪行，酌情予以从轻处罚。被告人王平当庭自愿认罪，酌情予以从轻处罚。法院遂依法作出以上判决。
