摘要：

　　美国“301条款”法律制度是美国贸易代表利用贸易政策推行其价值观念的一种手段，其威力不在于条款本身，而在于它所带來的报复性后果和制裁的可能。其核心是以美国市场为武器，强迫其他国家接受美国的国际贸易准则，以此维护美国的利益。实际上，美国的贸易政策是攻击性的单边主义，通过潜在威吓的作用打开外国市场，是一种典型的为了美国的利益恶意运用权利，达到美国的贸易目的行为。中国贸易法律体系的建设和国外文化的本土化问题应当以中国最大的潜在市场为前提，借入世机遇，调整和完善中国的公平法律体系，保持对外威慑力和制裁性。

　　The Legal Review of the U.S.‘Trade Law of 301 Terms——Insight of lesson for China Laws

　　Abstract：

　　The system of the U.S.‘s 301 terms is a kind of way that U.S.’trade delegation promote their value ideas via the way of trade and the function of the terms of 301 is not only the self of terms but also the possibility of the sanction and punished. The core of 301 terms is to force the other states to accept the principles of U.S. and protect U.S.‘benefit via the U.S.’market. In fact，the U.S.‘trade policy are a kind of attack mono-action and the power management to protect U.S.’benefit via the opening the foreign trade market. The issue of China laws construction and the nationalization of the foreign culture shall regulate and improve the China Fair Laws system and insist the foreign sanction under the condition of the China Sustainable Market on the basis for China Government to access to WTO.

　　一、引言

　　第二次世界打战以来，美国以其强大的经济优势，在国际贸易体系中处于绝对优势。同时，借助其强大的经济优势，推行具有典型美国价值观念的自由贸易政策。随着欧洲一体化的形成和东亚经济的迅速崛起，美国的贸易收支恶化，因此美国的贸易政策出现了巨大的转变——由积极的贸易自由政策转向贸易保护政策。以1974年的《贸易法》的“301”条款为代表的美国贸易保护法律体系成为美国保护其内国利益的有利武器，对世界贸易和法律产生重要影响。
