怎样提起离婚？

  
   离婚，是一种法律行为，必须符合离婚的条件，履行必经的法律程序。离婚有两种形式：1、登记离婚（通称协议离婚）；2、起诉离婚。 
   《婚姻法》第三十一条规定：“男女双方自愿离婚的，准予离婚”，是指登记离婚（协议离婚）。 
   登记离婚应由申请离婚的夫妻双方向民政局婚姻登记机关递交书面申请，并出具单位或居（村）民委员会介绍信，填写《离婚申请表》，民政局婚姻登记机关查明确系夫妻双方自愿，申请书是双方真实意思的表达，并且对家庭共同财产和子女的抚养、教育、医疗费的分担达成协议，民政局婚姻登记机关在收到离婚申请书之日起三十日内作出准予离婚决定，收缴双方当事人的结婚证书，发给离婚证。 
   《婚姻法》第三十二条规定：“男女一方要求离婚，可由有关部门进行调解或直接向人民法院提出离婚诉讼”，是指起诉离婚。 
    起诉离婚是指夫妻双方单方提出离婚，另一方不同意离婚或者虽然双方都同意离婚，但在共同财产的分割和对子女的抚养、教育、医疗费等的问题上未达成协议，离婚诉讼当事人可向人民法院递交离婚诉讼状，人民法院受理后一般采取两种方式解决：一是调解离婚，是指离婚的双方当事人在法院的调解下，就财产分割、子女养育等问题达成一致，人民法院批准其离婚并制作离婚民事调解书，作为双方当事人的离婚法律文书。二是判决离婚，是指人民法院在调解无效的情形下，就离婚案件的具体情况就夫妻共同财产和子女养育等作出离婚判决。 
   判决离婚后，人民法院自立案之日起1－3个月作出判决，最长不超过六个月。
