两高司法解释严禁在男性保健食品中添加“伟哥”

      最高人民法院、最高人民检察院发布《关于办理危害食品安全刑事案件适用法律若干问题的解释》。基于当前保健食品中非法添加禁用药物易发多发的特点，《解释》明确禁止在男性保健食品中添加“伟哥”等。 　　《解释》明确提出，严厉打击食品非法添加行为。食品非法添加行为的危害极其严重。为依法惩治此类犯罪，《解释》第九条首次从三个方面明确了法律适用标准问题：
　　一是针对实践中存在的使用有毒、有害的非食品原料加工食品的行为，如利用“地沟油”加工食用油等，明确此类“反向添加”行为同样属于刑法规定的在“生产、销售的食品中掺入有毒、有害的非食品原料”。
　　二是基于国家禁用物质具有的严重危害性，明确国家禁用物质即属有毒、有害物质，凡是在食品中添加禁用物质的行为均应以生产、销售有毒、有害食品罪定罪处罚；
　　三是基于当前保健食品中非法添加禁用药物易发多发的特点，如在减肥保健食品中添加副作用危害严重的“西布曲明”等药物成分，在男性保健食品中添加“伟哥”等，明确规定对此类行为应以生产、销售有毒、有害食品罪定罪处罚。
