建立多种纠纷解决方式，赋予当事人程序选择权，从法律上保护当事人对程序或实体上权益的处分，不仅是妥善解决纠纷、节约社会资源的需要，同时也意味着国家对公民基本自由的尊重以及相关制度保障机制的完善。尽管如此，笔者仍要特别指出的是：行政诉讼调解制度的构建需要得到健全而完善的行政诉讼制度的支持，甚至需要整个行政法治大背景的支持，而且作为一种辅助性的行政纠纷解决方式其作用也不宜过分夸大。

　　On status and task of the mediation system in administrative litigation in China

　　Abstract：From the view of system designers， it is essential to establish the self-constrained system of administrative dissension resolve， which can protect rights and interests of private party in the administrative process， put up administrative agencies into administrating according to law. From the view of system users， it is indispensable to establish many ways in dissension resolve， which can fulfill both parties‘ procedure selective rights. Confrontation with the plight in the mediation system in administrative litigation， the system of administrative litigation in China must reconstruct some important task， such as， how to realize unconstraint and equality in mediation， how to assort with mediation and adjudgement， how to protect both parties’ regret rights and how to realize the constraint of settlement contract.
