目前，我国立法上虽未明确赋予检察机关民事起诉权，但婚姻法的修改及无效婚姻制度的确立，既为建立检察机关提起民事诉讼机制以及赋予检察机关对无效婚姻案件行使请求权奠定了更加牢固的实体法基础，同时，更需要检察机关通过提起民事诉讼的方式保障其实施。这不正是修订婚姻法及无效婚姻制度的确立对检察机关的民事起诉权产生的深刻影响吗？对此检察机关特别是民事行政检察部门在司法实践中也应予以大胆尝试，为进一步完善立法奠定基础。
以上，是笔者结合对一起离婚申诉案件的审查对修订婚姻法的相关制度及其对民事检察监督权的影响所阐述的一点粗浅看法，有不妥之处望批评指正。
Abstract: The revised Marriage Law has much improved the rules and regulations concerning in our country, surely stands out as one of the most notable landmarks in the marriage legislation. However it should not be overlooked that there still exist some problems in the establishment of rules. This article, through an appealing case in which both of the interested parties refuse their acceptance to the final adjudication of court, is attempting to do some analyses on some rules and regulations closely related to the revised Marriage Law and their influence upon the civil procuratorial superintendence.
