Abstract: It is practically not appropriate for environmental pollution damage compensation procedural prescription to last legally from three years to twenty years based on our legislation. Due to the indirectness, complexity, protracted nature, latency period, vagueness of cause and effect, difficulty of gaining evidence, inequality of the litigants to a lawsuit of environmental pollution damage compensation, the academic circles tend to make a suggestion that the longest procedural prescription should be prolonged 30 to 50 years. However, the suggestion is thought to be in the lack of related references both home and broad. Without changing the period of procedural prescription, and with the condition of “a definite the accused” in a lawsuit, it will probably be better to solve the problem by changing the environmental pollution damage compensation procedural prescription. That is to change from “the time of counting，the litigant knows or should know the environmental pollution damage” to “ the time of counting the litigant knows or should know the environmental pollution damage and the environmental pollution damage to people”. This can also applied to environmental damage lawsuit.
