内容摘要

　　本文从完善我国破产制度的需要、公平正义的理念、我国司法实践的现状以及与国际私法接轨的需要等现实问题出发，认为我国通过破产程序对自然人免责势在必行。在简要阐述的一般理论和分析目前世界各国立法状况之后，建议我国应采取一般人破产主义，将自然人纳入新《破产法》主体范围之内，对自然人实行许可免责制度，以完善我国破产立法。并从有限制的免责制度、条件、与自由财产界限，制度以及破产程序的规定等方面提出了构建我国个人破产制度的几点设想。

　　This text sets out from perfecting such realistic problems as need , idea , administration of justice current situation and need that integrates with the private international law that are practised of our country of fair justice of the bankrupt system of our country ,etc., think our country avoids the responsibility to the natural person imperativly through the procedure of bankruptcy. After explaining the general theory that individual goes bankrupt and analysing the legislative state of countries all over the world at present briefly, propose our country should adopt bankrupt doctrines of common people, include the natural person in the subject range of new " bankruptcy law ", permit avoiding the responsibility system to the natural person, in order to perfect our country\\\'s bankrupt legislation. And from have restrain from exempt responsibility system , is it apply for terms , bankrupt property and freedom property demarcation line to go bankrupt, such respects as the system of bankrupt conciliation and regulation of the procedure of bankruptcy ,etc. have proposed structuring several points of our country\\\'s personal bankrupt system to imagine.

　　个人破产制度的确立是破产法的一个重要内容，国外大多数国家早已把自然人纳入到破产主体范围之中。随着现代经济的整体化、规模化、社会化程度的日益提高，在WTO背景下，我国现行企业破产法在当前多种所有制并存的形态下，早已不适应社会经济发展需要。因而，突破现行破产法狭隘的主体适用范围，制定一部新的囊括个人破产制度在内的符合市场经济体制的统一破产法势在必行。[1]国新《破产法》草案中已出现了自然人破产的条款，这表明个人破产即将在中国成为事实。因此，在我国采用个人破产制度，是发展市场经济的必然要求，也是同国际私法接轨的必然选择，更是贯彻法的公平价值理念和完善个人信用机制的需求，其对经济发展和法制建设有重大意义。
