【摘要】从《气候变化框架公约》到《京都议定书》，“京都时代”国际气候立法的发展对各国的能源法制产生了深远影响。2007年印尼巴厘岛会议的召开以及“巴厘岛路线图”的制定，标志着国际气候变化领域的“后京都时代”即将来临。中国作为温室气体排放大国，其能源法制在“后京都时代”面临着严峻挑战，亟需对其进行调整和变革。本文从能源法制理念、能源管理体制、能源立法体系、能源法制具体制度、能源国际合作法制等方面提出了“后京都时代”我国能源法制完善的具体思路，以期为实现我国能源可持续发展战略提供法制支持。

　　【英文摘要】From the Framework Convention on Climate Change to the Kyoto Protocol， the development of the legislations of international climate had a profound impact on every country's energy legal system. The convening of the Bali meeting and the enactment of the Bali road map marks the approaching of the post-Kyoto era in the field of international climate change. As a big emission country of greenhouse gas， Chinas energy legal system is faced with severe challenges in the post-Kyoto era， and it needs urgent adjustment and adaptation. This thesis put forward specific ideas to improve Chinas energy legal systems in the post-Kyoto era from the fields of the legal concept of energy， energy management system， energy legislation system， the specific legal system of energy and the legal system of energy international cooperation， with a expectation to provide legal support to Chinas sustainable energy strategy.

　　气候变化作为正在成为深刻影响21世纪全球发展的一个重大国际问题，与各国的能源结构和能源使用方式直接相关。煤炭、石油和天然气等廉价化石燃料的无节制使用增加了大气中二氧化碳浓度并最终引起全球气候变暖，因此，改善能源利用结构、减缓气候变化的有力措施就是实现能源革命与“低碳经济”。而能源法制在能源革命的进程中具有重要的战略意义。从《气候变化框架公约》(以下简称《框架公约》)到《京都议定书》(以下简称《议定书》)的制定，再到“巴厘岛路线图”的出台，国际气候变化立法的不断深入对于各国的能源法制都产生了深远的影响。“后京都时代”即将到来，中国作为温室气体排放大国，如何有效应对我国能源法制面临的各项挑战，实现我国能源可持续发展战略，就具有了十分重要的现实意义。
