欧盟的反托拉斯法执法，与合并控制法执法机制，除了上述所说的管辖权和审核方式的不同外，在适用法律上也存在根本不同。欧盟委员会的方案原本也想规定欧共体竞争法的排他性适用，但在正式条例中却规定了欧共体法与成员国法的共同适用，只不过欧共体法具有优先效力。这与合并控制中泾渭分明的法律适用形成明显对比。??
