【摘要】当今各国，随着经济社会的发展，环境污染等问题的大量涌现，由此引发的环境侵权群体纠纷也大量涌入法院，使各国共同面临着集团性侵害造成的小额多数权利救济问题，此类群体纠纷成为困扰各国社会稳定的一大难题，如何高效稳妥地处理这类群体诉讼，更是各国司法机关面临的严重挑战。示范诉讼制度正是基于这样一种现实需要而产生，发挥着其他环境侵权纠纷解决机制不具有的功能，本文将对此制度从价值与功能、可行性、实现路径方面展开论述。

　　【英文摘要】At present， all countries， with the economic and social development， happen lots of environmental pollution issues .Mass tort such as environmental infringement disputes which happens after these issues flows into courts， so that all countries are faced with the issue caused by group abuse which leads to a small majority right to relieve .This kind of mass disputes become a major problem which feaze the social stability in many countries.How secure and efficient to deal with these disputes ， it is a serious challenge to the judiciary of many countries . Model action system is based on this need of the reality playing the important role which other environmental tort settlement mechanism does not have . In this article ，the author will expound the value and function of this system， the feasibility ，the realization and the practice path on the field.

　　一、问题的提出

　　随着经济社会的发展，特别是工业化和城市化的大规模迅速发展，由环境污染和生态破坏所造成的环境侵权案件不断涌现，由于其多发性和影响的广泛性，往往侵害一定范围内多数居民的人身财产权利，故成为现代社会的一种新型群体性纠纷。对于环境侵权这种新型群体性纠纷不断涌现的社会现实，两大法系不断创建新型的群体性纠纷解决机制，其中最为典型的当数示范诉讼。尽管我国现行法律对示范诉讼制度未作明确规定，但在司法实践中，有许多群体案件的处理自觉不自觉的采用了类似国外的示范诉讼的做法，甚至目前我国已经成为世界上实际运用此类程序处理群体案件数量最多的国家。但目前我国在已有的纠纷解决机制的论著中，鲜有对该制度的深入研究，偶有论及，也仅限于简单的介绍。故笔者认为，我们有必要对示范诉讼制度进行理论研究，完善制度构建，这对有效解决不断涌现的环境侵权这一新型群体纠纷的司法实践是十分有意义的。
